TOWN OF VERMONT BOARD MEETING

MARCH 14, 2005

The meeting was called to order at 7:30 p.m. by Chairman Steven Frame. The clerk certified the notice had been posted at the Black Earth State Bank, Amcore Bank in Mount Horeb, on the town web site www.townofvermont.com and on the front door of the town hall; published in the News Sickle-Arrow and the Mount Horeb Mail.

Present: Chairman, Steven Frame; Supervisors David Dybdahl, Barbara Grenlie, Mark Sherven and Bill Hanson; Treasurer Sarah Danz and Clerk Marian Swoboda.

There was no citizen input.

APPROVAL OF MINUTES

Motion was made by Barbara Grenlie seconded by David Dybdahl and carried to approve the February 9, 2005 meeting minutes.

REPORT OF THE TREASURER

Treasurer Sarah Danz reported deposits of $115,789.78 during the month of February consisting of $113,402.61 in property taxes; $215.84 property tax refunds; $1,600.00 from site visit application fees; $125.00 title company assessment searches; $38.84 delinquent personal property tax payment and $406.49 from earned interest on accounts.

The February reconciliation of accounts showed $18,199.38 in the investment account, $88,581.01 in the savings account and $4,890.17 in the checking account giving a cash balance at the end of February of $111,670,56.

REPORT OF THE CLERK

The February balance sheet prepared by the clerk verified the cash account balances reported by the treasurer. The Income & Expenses vs. Budget report showed accumulative income and expenses through February.

After looking at the school taxes paid by property owners in the Town of Vermont the board at its February meeting asked the clerk to find out how the levies are determined. The clerk presented the following findings. First, equalized property values determined by the state form the basis for calculating the levies. The number of students served does not enter into the equation. Secondly, the school districts determine their budgets independently under state laws. The mil rate is determined by dividing the total levy placed upon the municipalities in the school district by the equalized value of all municipalities. In the case of the Mount Horeb Area School District the total 2004-2005 budgeted levy was $8,013,278 with nine municipalities involved. The equalized value of all nine was $842,428,562. Thus dividing the budget by the equalized value results in a mil rate of 0.0951211. To find the levy placed upon any one municipality the individual equalized value is multiplied by the mil rate. The Town of Vermont has an assessed value of $41,340,686 for that portion of the town within the Mount Horeb School District. Dividing that amount by the mil rate imposes a levy of $393,237.36 upon the property owners or 4.907 percent of the total budget.

Following the same formula, the mil rate for the Wisconsin Heights School District was 0.1091516; the total budget $5,181,887 divided by equalized value $474,741,926.The Wisconsin Heights School district serves nine municipalities. The Town of Vermont's share of the total budget was $718,390, the mil rate times the equalized value $65,815,814, that portion of the town within the Wisconsin Heights School District; or 12.703 percent of the total budget.

PAYMENT OF BILLS

Motion was made by Bill Hanson seconded by David Dybdahl and carried to approve the payment of bills covered by checks numbered 10392 through 10425.

INTRODUCTION OF TOWN ASSESSOR, CHARLOTTE JOHNSON

Charlotte Johnson the new assessor for the Town of Vermont was introduced. She responded by saying she was pleased with having been selected and would be in the town for the week taking pictures of properties and buildings.

PETITION #9176, MICKLESON TRUST AND STEVEN HOLZHUETER

Motion was made by David Dybdahl seconded by Bill Hanson and carried to approve the recommendation from the Plan Commission to approve Petition #9176 to rezone 2 acres within a 37.19 acre parcel from Ag-1Ex to RH-1 along with a home site within the 2 acres and a driveway off from Dalby Road. Gaylord Mickleson Trust, owner; Steven Holzhueter, applicant. Barbara Grenlie abstained from voting.

PETITION #9193, CAREY & MIA BOMKAMP, OWNERS AND APLICANTS

Motion was made by Mark Sherven seconded by David Dybdahl to approve the Plan Commission recommendation to approve petition #9193 to rezone 2 areas within a 36.4 acre parcel from Ag-1 Ex to RH-1 and to rezone the remaining 34.4 acres from Ag-1 Ex to A-2 along with home site and driveway approval in Section 18 off from Zwetter Road. Carey & Mia Bomkamp, owners and applicants. The question of whether or not the 34.4 acre parcel would be granted a potential building site under county code was considered but it was felt because the 2 acres and the 34.4 acres are considered one parcel the county code would not apply. The motion then carried. Barbara Grenlie abstained from voting.

AMENDMENT #18 TO DANE COUNTY ORDINANCES

Motion was made by Mark Sherven seconded by Barbara Grenlie and carried to approve the amendment to Chapter 10, Dane County ordinances providing for agricultural based education and entertainment in the A-1 Ex agriculture district. AMENDMENT #28 TO DANE COUNTY ORDINANCES

Motion was made by Mark Sherven seconded by Bill Hanson and carried to disapprove amendment #28 to amend Chapter 10 of the Dane County Code of Ordinances, regarding appeal of conditional use permits to the county board.

AMENDMENTS #31 AND #32 TO DANE COUNTY ORDINANCES

Motion was made by David Dybdahl seconded by Barbara Grenlie and carried to approve ordinance amendment #31 amending Chapter 10 of the Dane County Code of Ordinances, modifying the adult entertainment overlay district and Amendment #32 amending Chapter 10 of the Dane County Code of Ordinances, regarding adult entertainment establishments.

RECREATIONAL ACTIVITY PERMIT APPLICATION

Following discussion of state statutes 346.80 pertaining to bicycle riding on roads,

Motion was made by David Dybdahl seconded by Mark Sherven and carried to approve the third draft of the proposed changes to the Recreational Activity Permit Application.

RECREATIONAL ACTIVITY PERMIT APPLICATION REQUESTS

Members of the Atkins Citizens Racing Club were present to seek approval of their event scheduled for July 16, 2005.

Motion was made by Bill Hanson seconded by Mark Sherven and carried to wait for an evaluation of the application from the Dane County Sheriff's department before making a determination

BUILDING INSPECTOR RETIREMENT

Motion was made by Mark Sherven seconded by Barbara Grenlie and carried to accept the retirement notification from Jim Ludolph as the building inspector for the town and to approve the drafted advertisement seeking bids for a contractual building inspector. It was suggest that the state Department of Commerce be contacted for information on certified inspectors in the area.

2005 ROAD BID LETTING

Motion was made by Bill Hanson seconded by Mark Sherven and carried to approve the letting of road bids by the end of March.
